A class-action lawsuit by a group of tenants at a Weehawken luxury apartment complex over security is moving forward after an appellate court panel affirmed an earlier ruling that the agreement to waive such suits was unenforceable.
The panel rejected the argument by Hamilton Cove’s owner, Hartz Mountain Industries, that the lawsuit, which stemmed from a claim made to prospective renters that there was around-the-clock security, should be dismissed because the tenants’ lease includes a clause that waive their right to file or take part in a class-action lawsuit against the property.
The lawsuit was brought by William Pace and Robert Walters on March 31, 2022, and it says Hamilton Cove’s advertising claim of providing “elevated, 24/7 security” at its three buildings was false. The suit was filed by the Costello and Mains law firm, and handled by Lauren Bess and Miriam S. Edelstein.
After moving into the 573-unit complex on the Hudson River waterfront, Pace and Walters found in June 2020 that the apartments’ security cameras were broken and that in at least one building, a front desk greeter/mailroom attendant was stationed at the front of the building just six hours a day on weekdays (11 a.m.-5 p.m.) and less time on weekends.
By February 2022, the front desk greeter’s weekday hours were extended to 9 p.m., with more consistent staffing on weekends, but the building never provided the “24/7″ security as promised, the lawsuit said. In a motion to dismiss the lawsuit, Hamilton Cove argued that the tenants were allowed to file lawsuits individually, but in their lease agreements they waived any right to file or participate in class action.
In the 16-page appellate court ruling released Wednesday the panel said the waiver could not be enforced because the tenants had not been offered arbitration.
“Considering our longstanding, fundamental public policy favoring class actions, we hold there is no societal interest in enforcing a class action waiver in a contract that does not contain a mandatory arbitration provision and conclude that the class action waivers in this case are unenforceable as a matter of law and public policy,” the ruling said.
The lawsuit asks for unspecified compensatory and punitive damages, the installation of working cameras and around-the-clock security as initially promised, and for the management to refrain from advertising amenities and services that are not delivered. In the event the 24/7 security and working security cameras are not in place at the time of the court order, the lawsuit ask for a reduction in rent to compensate tenants.

The Panthers rode 14 strikeouts from Cayce Kavakich and a key inside-the-park homer from Gabriella Florre to down Weehawken, 3-1, Tuesday in the Group 1 softball semifinals.
For Weehawken, it was the end to an historic season in which they won league, county and sectional title in the same year for the first time.
“Throughout the season, we have made history, and it’s because of every girl on this team,” Weehawken coach Raquel Roder said. “It was a team effort and they literally have nothing to be upset about. They played excellent the whole season.”
The Panthers (26-3) got revenge on the Indians after losing to them in the 2022 sectional final. They advance to the Group 1 final against the winner of New Egypt and Clayton on Saturday.
Weehawken’s loss means the end of the North Jersey softball season. The Indians were the only team from the area to win a section and will be contenders again with just about every starter back, including standout junior pitcher Savanna McHale.
“Probably right now,” Roder said laughing when asked when she starts planning for next year. “I think we need to take a second and reflect on how far we have come. Realistically, we have 4-5 girls who have been playing for a long time. The rest of my girls have come up from JV or never played before. We have a really young team, so it’s a good thing for us.”
Weehawken took a 1-0 lead in the bottom of the first on an RBI single by Envey Duran scoring Kat Thompson who was hit by a pitch and then moved to second on a wild pitch.
Cedar Grove answered with a sac fly by Daniella D’Angelo in the second and took the lead on a two-out inside-the-park home run by leadoff batter Gabriella Florre, who sliced a ball just down the left field line past a diving Bella Veras.
“You hear all these things, keep these girls off the bases,” said Roder. “I don’t blame the umpires, but it was a very tight strike zone, and if you let one hang [over the plate] and a ball gets put in play like that in a tough spot that rolls [away]. What are you going to do?”
Florre scored standing up and Kavakich did the rest, limiting Weehawken to two hits and striking out the side in the seventh. Ava Oeckel added an RBI single for Cedar Grove in the fifth.
As the game wore on clouds and smoke from the Canadian wildfires gave the field a distinct haze and made it difficult to see the New York City skyline.
“They have nothing to hang their heads about,” Roder said. “Everyone was telling us it would be a blowout and the fact that we scored early and held them off and gave them a game, we did a really good job. Now we prepare for next year. We want to get to this spot again.”

Open seven days a week, this place is great to visit for brunch (on weekends), lunch, or dinner, and they even have a separate vegan/vegetarian menu. The brunch game here is also strong. You can order a la carte or the pre-fixe menu which is $39 for one brunch item and 2 bellinis, mimosas, or bloody marys. The Mitsuwa Marketplace has various Japanese stores and groceries. Hudson Pot is located right on the water, so diners can enjoy their Japanese fare with gorgeous views of upper Manhattan. Located just down the street from Sojo Spa, this could be a great spot before or after a relaxing massage. The menu itself includes different vegetarian and meat pots with broth and noodles or rice, as well as other dishes.
Tucked behind a few different apartment complexes, Molos can be quite unassuming but don’t sleep on this place. It’s a luxury, upscale Mediterranean restaurant specializing in seafood. There are a few signature dishes including a full fish and saganaki flame, a Greek flaming cheese dish. The sustainable menu also includes classic dishes like filet mignon souvlaki, fresh fish market, and different farm-to-table sides. Make sure to adhere to the smart casual dress code.

Complete with indoor and outdoor dining, Pier 115 feels like a little oasis in Edgewater. The menu ranges from wood-fired pizzas to sushi, and it’s all delicious. Getting here might be a bit confusing, but just keep walking to the water, and when you get there, keep going. The entrance is closer to the end of the piece at the end of the open-air parking garage. The beer list is extensive, as are the TVs filled with different sports games. On the weekends this place is open late, until midnight.
Just off Port Imperial Boulevard, Son Cubano boasts an impressive Cuban menu with live music. This Supper Club has $10 signature cocktails and great appetizers to start (The Hoboken Girl recommends the guacamole). This month, Son Cubano is having dinner and a show with West Side Story presented by critically acclaimed Broadway actors. Check the website for more information. The views here are epic (you can see all the way to the Statue of Liberty), but the interior is also just as lovely. During the warmer months, make sure to sit outside if you can (though it is heated all year round). This trendy place has a great menu, especially for brunch. HOBOKEN, NJ — As temperatures soar into the 80s in Hoboken — and are expected to reach 90 this coming week — Hoboken offered updates on the future of pool development and announced pool hours to come at Hoboken High School.
Those hoping to swim at a public pool this weekend will have to head to another Hudson County town. But the closest out-of-town pool, a mile away in Weehawken, offers only season passes for Hoboken residents while continuing to buck a state requirement to offer day passes as well, for occasional use.
The state provided $4 million in Green Acres funding for the pool complex, meaning the town has to open it to all New Jersey residents. According to DEP rules, if the pool sells season passes, it must also offer day passes for those who want to visit only occasionally.
Weehawken Mayor Richard Turner recently told NJ.com that the majority of out-of-town pool visitors come from Hoboken, but that he's not fond of the day pass idea.
"The problem with DEP is first of all, they’ve never had to run a pool that’s as popular as this one and secondly, they’re not flexible enough to allow us to experiment,” Turner said.
Last week, Councilman Phil Cohen, in his newsletter, listed the hours and season pass rates for the Weehawken pool.
"I have discussed these issues with Weehawken Mayor Richard Turner and am pleased that Hoboken’s residents have this opportunity to enjoy this Hudson River waterfront pool complex this summer," he said. When asked which "issues" he discussed and whether he discussed the day pass issue, he didn't respond.
Patch also reached out to the city on Wednesday night to find out when pool hours would be announced for Hoboken High School, and if low-cost swim lessons would be offered this year.
Patch received no reply, but the next day, the pool hours were announced.

A Pool To Come, And Hoboken High School Pool Hours
The city announced Thursday that a new pool complex will be built at the Hoboken Multi-Service center at 124 Grand St. (This is separate from the announcement about the 800 Monroe St.complex and potential pool there last month.)

Meanwhile, the city noted on Thursday that there will be more hours for the community at the Hoboken High School pool this summer than last summer. Signups for a slot begin this coming Monday, July 3.

The Hoboken High School indoor pool will be open to residents this July and August through a partnership between the City of Hoboken and the Hoboken Board of Education.
From July 10 through July 27, the pool, located at 800 Clinton St., will be open Monday through Thursday from 3:30 p.m. to 7:30 p.m. and on Saturdays from 11 a.m. to 3:30 p.m.
From July 31 through August 10, the pool will be open Monday through Thursday from 11 a.m. to 3:30 p.m. and on Saturdays from 11 a.m. to 3:30 p.m.
Participants must first register to utilize the pool at Hoboken.RecDesk.com. Registration will open on Monday, July 3, at 9 a.m.
Children under the age of 18 must be accompanied by an adult or have a waiver from their parent or legal guardian to use the pool without an adult present.
The pool capacity is capped at 20 swimmers, and access will be provided on a first-come, first-served basis. A lifeguard will be on duty during all open hours.

Weehawken Town Administrator Gio Ahmad told Patch last month that for summer 2023, the Weehawken pool would be open to all New Jersey residents for free through June 23. But the town's subsequent announcement of a season pass-only system received some criticism from some Hoboken residents as well as some in Weehawken.
Last year, when Hoboken residents were finally allowed into the Weehawken pool for mornings in August, several city officials thanked each other as well as Weehawken's mayor, which drew some jeers.
